The pegasus wasn't on our side...infact, it wasn't until after we left that the pegasus came into play.

And it was Elendil who posted of the Pegasus's being.
Do you have a link to the exact battle. Not directions but a link? I need to read it completely.

As we learn from page 5 of the trial, these are the events as they transpired. I do not see anywhere that Elindil was actually speaking to you. From what I have gathered here, she was moaning.

[Elendil]Any pirates around??? I wana duel!!![Apolo]I be the only pirate online, but I kinda want to go to bed *Yawns*[Elendil]Please!?!?!?!?![Apolo]Okay, BUT JUST A LITTLE!!!!!!*Yawns again. Sleepily draws sword and jabs at her chest*[Elendil]dodges* Come on! Wake up!!! Remember what happened last time!!![Apolo]Yep, thats why I wana go ta bed.......*Snore... He then wakes up and slashes at her side*[Elendil]*Snorts* A scratch! Maybe this will wake you up! *Brings sword down on Cook's wrist.*

On the next move, Apolo used his teleporting powers to go behind Elendil and stab her in the back. But he never specified where, as you can see:

Within a few miuntes, the cook has a pirate pain remody made for her* `Ere, drink this.

Even though he wounded an enemy, he still realized what he did was wrong, and tried to fix his error.
Elendil, however, did not want to accept his help.

May I also point out that they never agreed on any rules for this duel.

After Elendil passed out, Apolo poured the remedy down her throat, and tries to stop the bleeding.

It was after this that I stepped in and helped Apolo with his predicament.

After a few minutes we decided that her wound needed to be stitched up ( not knowing at all that she was stabbed in the spine. For she did not inform us of this until after Lionsmane came on) so i went to the ship to get the equipment. When I came back, Lionsmane appeared and called us foul beasts. he drew his sword, not realizing that we we're infact saving her life

I told him that we we're helping her, but he did not lower his sword. This was posted at 12:31 A.m.

At 12:49 a.m., Elendil posted that blood was oozing from her mouth, and then shortly after, she posted that her eyes rolled back into her sockets and she moans.

Inbetween these two posts, I helped Elendil, or tried to.

Also inbetween this post, Lionsmane makes an ooc comment.

I make known, based upon facts from the occurrences on the night of the death, that we do not see that Elindil was at all able to converse with anyone after being stabbed in the back.

You only have it when I'm healing her.

From the point of me bringing her back, she is talking.

Me said:
I'm aware of that! I'm not daft. Where were you stabbed?
Hup, hold on. * Takes out pistol and shoots pegasus through the skull*

Now, what were we saying?

(this was also the post that was completely ignored)

In de back aka spine!

Me said:
Where on the spine? I understand you said you were stabbed there, I'm speaking how far up the back or how far down...

elendil said:
Oh I du know, the middle!

Another fact about this is that Lionsmane's post saying she was dead happened in the middle of the conversation. She kept talking to me through it all.

As far as what I can tell, the conversation that took place between her and ioww regarding the "spine" was ooc.

'ooc' was never even said in any of the posts. Your 'assumptions' mean nothing in this case, but our testimonies and the facts do.

This particular "evidence" is therefore dismissed. Unless we can reasonably conclude in this case that she spoke either "ic" or "ooc," it bears no weight.

That's like saying Apolo's atempt to help her was 'ooc'. Whatever hapened, happened. And what happened was, she was talking to me the entire time, up until the point Lionsmane told her she was dead.

I have to leave, and will not be back, and since today is the last day, I think I still stand by this verdict:
Apolo is NOT GUILTY

Having reviewed the situation, I find that:
No one but Lions Mane can be blamed for the death of Lions Mane, so that case is closed.
Apolo Anton Ohno, while not guilty of murder, IS guilty of violating the rules of a fair duel. My suggested sentence is this: Apolo shall not be allowed to use his powers of teleportation for a month AND Apolo must cook for all: Knights, Pirates, Rangers, and Mandalorians for one month.
I ALSO find that the group that DID cause the death of Elindil should be embargoed and shall not be communicated with (I forget, was it the Dark Army or the Council of the Beasts that killed him? Whatever one it is, they get those terms)

*Apolo loosens the rope around his hands to make himself a bit more comfortable* Um, do I die yet?
*Fish fingers her hammer and nails*

Me threat still stand, Matey. Stop saying that yer gonna die or I be making so that ye can't say anything.

EDIT: When the pirates ship out and go back to sea where we feel most at home, ye had better believe that Apolo be coming with us. Therefore he could not cook for everybody because he will not be near everybody.

Ya Ya Ya Ya Ya! *Apolo nods his head qiukly*
